Terms of Service

Effective April 28, 2026

These Terms of Service (“Terms”) govern your use of the Better Call service (the “Service”). By creating an account or using the Service you agree to these Terms.

1. The service

Better Call provides an AI receptionist that answers inbound phone calls on behalf of trade contractors. The Service may take messages, schedule callbacks, send confirmation SMS, and forward emergency calls to a designated on-call number.

2. Accounts

You must provide accurate information and keep your account credentials secure. You are responsible for activity under your account, including the configuration of greetings, routing rules, and on-call numbers.

4. Emergencies

The Service is not a substitute for emergency services. If a caller is in a life-threatening situation they must dial 911. We make best efforts to forward emergency-flagged calls to your designated on-call number, but we do not guarantee delivery, response time, or call quality. You agree to communicate this limitation to your customers.

5. Fees

Subscription fees, per-minute call charges, and SMS fees are stated on the pricing page in effect at the time you sign up. Fees are billed in arrears at the end of each month. Late payments may result in suspension of the Service.

6. Termination

You may cancel at any time. We may suspend or terminate the Service for breach of these Terms, non-payment, or actions that put the Service or other customers at risk. Upon termination we will export your call data on request and delete it within 30 days.

7. Intellectual property

We retain ownership of the Service, our software, and any aggregated or anonymized analytics derived from usage. You retain ownership of your account data and call recordings.

8. Disclaimers

The Service is provided “as is.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of incorrectly transcribed or interpreted information.

9. Limitation of liability

To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost revenue, lost customers, or missed calls.

10. Governing law

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws rules. Disputes will be resolved in the state and federal courts located in Delaware.

11. Changes

We may update these Terms. We will post the updated version here and, for material changes, notify account administrators by email at least 14 days in advance.
